How to Protect Yourself in Brand Deals: Contract Terms Every Influencer Should Know

Brand deals can be exciting — but if you’re not careful, you could end up giving away too much or getting taken advantage of. Contracts aren’t just paperwork — they’re protection. Whether you're signed with an agency or negotiating solo, here are the key things to look out for:

  • Never agree to usage rights in perpetuity. This means the brand can use your content forever, without additional payment. Always ask for a specific timeframe (e.g., 3–6 months) and negotiate extra fees for extended usage.

  • Avoid termination “for any reason” clauses. Make sure the brand can only cancel the agreement with cause — like a missed deadline or major breach — not just because they changed their mind.

  • Always get a countersigned agreement. Do not start work until both parties have signed. This protects you legally and ensures you're aligned on expectations.

  • Limit the number of revisions. Two rounds of edits are standard. Without limits, brands can keep asking for changes indefinitely.

  • Add a late fee clause. Protect yourself from delayed payments by adding a simple clause that enforces a fee after a certain number of days past due.

  • Define deliverables clearly. Be specific about what content you’re delivering, how many posts, on which platforms, and when.

  • Include payment milestones. If the partnership involves multiple deliverables or spans weeks/months, set partial payments along the way.

When in doubt, have a manager, lawyer, or agency help you review your agreement. A strong contract protects your time, your creativity, and your peace of mind.
